Privacy Policy

Cotendo’s Commitment to Privacy

At Cotendo, we strive to protect customer, reseller and their affiliated entities' privacy while accessing or using our content delivery network services and/or providing us with access to their services. To protect the privacy of these entities, Cotendo has implemented a number of policies, as detailed in this document. “Cotendo” shall mean Cotendo Inc. and entities controlling, controlled by or under common control with Cotendo.

Customer and Reseller Confidential Information

As a developer and provider of content delivery network services and related value added services, Cotendo is committed to the following:

  • Not to solicit, gather, store, release or otherwise use personal information of its customers, resellers and/or individuals or other entities affiliated with its customers and resellers (collectively referred to as “Associated Entities”), provided that customary contact information of Cotendo Resellers and Customers shall be maintained in the ordinary course of Cotendo's business. Cotendo shall take all reasonable measures to ensure that only those employees and representatives having a need to know will have access to said contact information.
  • Not to monitor or store content belonging to or delivered by Associated Entities, except as occurs in the normal course of performance of Cotendo’s services.
  • Not to edit content belonging to or delivered by Associated Entities.
  • To employ high level, industry standard security measures in maintaining the integrity of the Cotendo content delivery network and related value added services, and in reducing the risk of exposing the content delivery network to third party hackers or other systems’ operators (see paragraph entitled "Security" below), except those operators with whom Cotendo has contractual relationships in order to assist in the delivery of its services.
  • To endeavor to remain continually updated concerning the latest methods and techniques for maintaining system privacy for the protection of our Associated Entities, and to employ such methods and techniques as circumstances may warrant.

Security

The network server facilities we utilize have physical, electronic and managerial security measures in place to protect against the loss, misuse and alteration of the systems and information under our control. We use secure servers with encryption for certain transactions and confidential data. We maintain a firewall to protect data within our local area network and our servers are maintained in secured access, locked facilities.

We allow only qualified Cotendo technicians or Cotendo authorized contractors to access to the data center facilities and space that house the Cotendo network servers. Our employees and contractors have signed on non-disclosure agreements, and are prohibited from reconfiguring Cotendo servers in any manner that may compromise the high level security protections implemented by Cotendo in providing its services.

Privacy Laws

Cotendo senior management has been involved in the development and delivery of internet based services for many years and, as such, it is well versed in the need to maintain privacy and comply with all relevant privacy laws governing the use, disclosure, maintenance, handling, etc. of third party user content. Cotendo shall continue to adhere strictly to all relevant privacy laws in providing its content delivery network services, and to treat sensitive and/or confidential third party information with the high degree of care necessary to ensure the privacy of such information.

Cotendo will honor all lawful and validly issued orders, search warrants and/or subpoenas that require Cotendo to turn over information it possesses to the requesting authority. To the extent allowable and possible, Cotendo will provide advance notice to any third party that may be affected by the transference of information to the requesting authorities. Furthermore, Cotendo retains the right to transfer information to authorities under exigent circumstances, in order to protect the physical safety of Cotendo property, its employees, users or the general public, or the property thereof.
